In the case of a remote purchase or when you cannot attend the notarial deed yourself, you will need a notarized and apostilled power of attorney processed by the Italian Consulate in your place of residence.
There are two options for obtaining this:
Option 1
In the Consulate of the country where you reside, there is a notary who provides such services not only to Italian citizens.
In this case, you just need to obtain a draft of the power of attorney from the Italian notary who will conduct the transaction. Then, pass the draft to the consular notary and sign the power of attorney. The apostille on the power of attorney, written in the language of the country where you reside, along with its translation into Italian, will be affixed there in the Consulate without additional certifications. The power of attorney is then ready to be sent to your representative in Italy.
Option 2
More common, if we're talking about countries outside the EU.
Sequence of actions:
1. You need to obtain a draft of the power of attorney from an Italian notary.
2. Find a translator from Italian accredited at the Consulate. Their list can usually be found on the Consulate's website. Typically, these translators can also recommend a notary who has experience in drafting documents for use in another country. The translator will translate the power of attorney into the language understood by the local notary and you. For example, into Russian for citizens of Russia.
3. The local notary will insert the information provided by the Italian notary into the text of the power of attorney, and you will sign it.
4. The same translator will then translate the full text of the power of attorney back into Italian.
5. You will contact the Italian Consulate, which will certify the translation and place an apostille on the original power of attorney and translation, stitching them into a single document.
6. You will send the power of attorney by courier to the address of your trusted person in Italy.
